SC issues show cause notice on CJ-led government; Special bench to decide the case
KATHMANDU: The Supreme Court has issued a show cause notice to the President, government and four major political parties over their bid to form an election government under the leadership of Chief Justice Khil Raj Regmi.
A single bench of SC Justice Sushila Karki asked the defendants to furnish written clarification till March 5, in response to a writ petition filed arguing that four major parties’ decision was against the spirit of Interim Constitution and would encroach on the independence of judiciary.
Advocate Bharat Jangham in his writ has argued that the government under the sitting Chief Justice is unconstitutional, demanding court order for a government headed by an independent person or a former Chief Justice.
According to today’s order, the final verdict on the petition will be issued following a discussion on March 7 in a special bench after the defendants furnish their written clarification.
It is however not clear whether the Chief Justice will lead the government or not. It is reported that the Chief Justice is awaiting the verdict of the Supreme Court for deciding whether to lead the government or not.
