SC issues show cause notice for holding CA elections
KATHMANDU: Acting upon a writ petition filed demanding to keep announcement for fresh elections to the Constituent Assembly (CA) on hold until and unless the Interim Constitution was amended, the Supreme Court Thursday has issued a show cause order in the name of defendant.
A single bench of JusticeTarkaraj Bhatt handed down the decision to this effect and ordered the defendant to be present before the court within next 15 days with written reply.
The Court also ordered to conduct a hearing on the case through special bench after the submission of the written reply from the defendant.
One Sambal Chulagain, 20, from Hetaunda Municipality-7 had on last Tuesday registered the petition at the Court demanding to keep the announcement for fresh elections to the CA on hold until and unless the Clause 63 ( 7) of the Interim Constitution was amended.
The Clause 67 (7) of the Interim Constitution of Nepal has allowed only those people completing 18 years of age by December 15, 2006 to take part in the CA elections and the people eligible for enjoying voting rights will be deprived of taking part in the fresh CA election if the provision was not revised, states the petition.
The petition has named the Office of the Prime Minister and Council of Ministers, the Election Commission and the Ministry of Law, Justice and Parliamentary Affairs as the defendants. RSS
