Regmi and President discuss EC appointments; CC finds nomination constitutional
KATHMANDU: A day after President Dr. Ram Baran Yadav has questioned about the constitutionality of the recommendations of the Constitutional Council for the appointment of office bearers of the Election Council, Chairperson of the Interim Election Council Khil Raj Regmi called on President Yadav on Saturday morning,
During the meeting, Regmi assured the President that the nominations would not violate any provision of the constitution, and urged him to formally name the commissioners at the earliest, an official at the President’s Office said.
The first meeting of the newly formed Council had recommended the names of the EC office-bearers. Along with Upreti, Yadav, and Gurung, the CC had named Ila Sharma and Ram Bhakta PB Thakur as the commissioners.
The President’s office in a letter to the Regmi-led CC had asked if re-appointment of Nil Kantha Upreti as Chief Election Commissioner (CEC) and Dolakh Bahadur Gurung and Ayodhi Prasad Yadav as commissioners will be in line with the constitutional provisions. Upreti was acting CEC while Gurung and Yadav were commissioners previously. Their tenure had ended few months earlier. The High-Level Political Committee of major four political parties had prepared the list and given to Regmi. Earlier today, Regmi had consulted the HLPC members and called on the President. As per the Article 38 (7) there is no provision of re-appointment of Election Commissioners.
Meanwhile, the meeting of the Constitutional Council held after Chairperson of the Interim Election Council Regmi’s meeting with President has decided to uphold its earlier decision saying the decision is as per the constitution. The meeting decided to write the President’s office that the decision is as per the constitution and forward same names to the president for approval. The leaders of the political parties informed that they also decided to go for the former elections commissioners to hold the elections of the constituent assembly in a short period as they have good experience in the field.
